Tim Hortons Franchisee Seeking Class-action Lawsuit

OTTAWA — A Tim Hortons franchisee is seeking a class-action lawsuit against Restaurant Brands International (RBI), alleging the company improperly used money from a national advertising fund.

Franchisee Mark Kuziora’s claim alleges that the RBI subsidiary, TDL Group Corp., has been charging administrative and operational expenses to the fund, while also failing to provide statements of the fund’s operations, which is required by franchise agreements.

The Great White North Franchisee Association (GWNFA) — of which Kuziora is a member — says the claim was filed because RBI “failed to adequately respond” to questions regarding the use of advertising funds collected.

RBI executives have rejected the allegations in the claim, which was filed in Ontario Superior Court on June 19.
